Die Lieferungen, Leistungen und Angebote des Verkäufers erfolgen ausschließlich aufgrund nachstehender Geschäftsbedingungen.
2.1.
In Prospekten, Anzeigen usw. enthaltene Angebote sind - auch bezüglich Preisangaben - freibleibend und unverbindlich. An speziell ausgearbeitete Angebote hält sich der Verkäufer 30 Kalendertage gebunden.
2.2.
Mündliche (telefonische) Angaben unsererseits sind freibleibend und unverbindlich.
2.3.
Im Zuge der Weiterentwicklung von Produkten behalten wir uns technische oder optische Veränderungen vor. Insbesondere sind Abbildungen von Produkten beispielhaft und können von den gelieferten Produkten abweichen.
3.1.
Die Gewährleistung beträgt für neu hergestellte Teile 2 Jahre und beginnt mit dem Datum der Lieferung.
3.2.
Offensichtliche Mängel müssen dem Verkäufer unverzüglich, spätestens jedoch innerhalb von zwei Wochen nach Lieferung schriftlich mitgeteilt werden.
3.3.
Schlägt die Nachbesserung oder die Ersatzlieferung nach angemessener Frist fehl, kann der Käufer nach seiner Wahl Herabsetzung des Kaufpreises oder Rückgängigmachung des Vertrages fordern.
3.4.
Die Rücklieferung reklamierter Teile hat auf dem kostengünstigsten Weg (in der Regel als Brief) zu erfolgen. Unfreie, nicht angekündigte Rücksendungen werden nicht angenommen.
3.5.
Durch den Einbau unserer Produkte kann die Betriebserlaubnis des betroffenen Fahrzeugs erlöschen.
4.1.
Schadensersatzansprüche gegen den Verkäufer aus positiver Forderungsverletzung, aus Verschulden bei Vertragsabschluss und aus unerlaubter Handlung sind ausgeschlossen, soweit der Schaden nicht vorsätzlich oder grob fahrlässig verursacht wurde. Dies gilt nicht für Schadensersatzansprüche aus Eigenschaftszusicherungen, die den Käufer gegen das Risiko von Mangelfolgeschäden absichern sollen.
4.2.
Der Einbau und Betrieb unserer Produkte erfolgen grundsätzlich auf eigene Gefahr.
Bis zur Erfüllung aller Forderungen, die dem Verkäufer gegen den Käufer zustehen, behält sich der Verkäufer das Eigentum an den gelieferten Waren vor (Vorbehaltsware. Der Käufer darf über die Vorbehaltsware nicht verfügen. Der Verkäufer ist berechtigt, vom Vertrag zurückzutreten, wenn der Käufer mit der Zahlung in Verzug kommt.
Die Zahlung hat unverzüglich nach Bestellung per Vorkasse zu erfolgen.
Widerrufsrecht:
Sie können Ihre Vertragserklärung innerhalb von einem Monat ohne Angabe von Gründen in Textform (z. B. Brief, Fax, EÂMail) oder durch Rücksendung der Sache widerrufen. Die Frist beginnt frühestens mit Erhalt dieser Belehrung. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an:

Widerrufsfolgen:
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung - wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre - zurückzuführen ist. Im Übrigen können Sie die Wertersatzpflicht vermeiden, indem Sie die Sache nicht wie ein Eigentümer in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt. Paketversandfähige Sachen sind zurückzusenden. Die Kosten der Rücksendung übernehmen wir ab einem Warenwert von 40,00 Euro. Verpflichtungen zur Erstattung von Zahlungen müssen Sie innerhalb von 30 Tagen nach Absendung Ihrer Widerrufserklärung erfüllen.

With regard to the data processing to be described in more detail below, users and data subjects have the right
- to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);
- to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);
